Andrej Babiš, the self-styled billionaire who secured victory in the recent Czech election, has refused to sell his vast corporate assets, while asserting he will resolve a ethical dilemma that might block him from assuming the position of prime minister.

Stance on Business Holdings

Babiš, whose political movement came first in the autumn vote but did not secure a majority in parliament, declared in a social media post that he would not divest his Agrofert conglomerate, which operates in agriculture, food production, and chemical industries.

“I have repeatedly said I will never sell Agrofert. I have consistently stated I will address the conflict of interest in compliance with national and European laws,” Babiš commented. “This is not like selling a roll in a bakeshop.”

Head of State's Demand

The Czech president, Petr Pavel, stated that the elderly populist must publicly explain how he will eliminate conflicts of interest stemming from his business activities before assuming the role of prime minister.

The national charter “explicitly requires the head of state to take into account the potential occurrence of a ethical issue and the ways to address it” when appointing cabinet members, Pavel's office explained.

The head of state “expects clarity in what specific way Andrej Babiš will meet his statutory duties”, the statement added, noting that Pavel was ready to appoint Babiš as prime minister “without delay” once the matter was resolved.

Business Operations and Legal Concerns

Babiš's several hundred companies, mostly under the Agrofert umbrella, operate in the nation and other regional states, receiving substantial funds in domestic and European agricultural and other grants, as well as government deals.

Under national legislation, cabinet members cannot obtaining public aid or contracts. The anti-corruption watchdog Transparency International has stated that to avoid a ethical breach, Babiš must either sell, refuse public contracts, or stay out of government.

Previous Term and Present Plans

Babiš affirmed he would “abide by the laws” if selected as premier, but did not want to detail how in advance because the matter was “an highly personal and personal matter for me, and journalists will always question me anyway”.

During his initial tenure as prime minister, from 2017 to 2021, Babiš faced multiple court cases and an European inquiry over possible conflicts of interest. He placed his assets into fiduciary arrangements, while keeping some influence over them.

A judicial body and the EU executive both determined that this was insufficient. Babiš stated recently that he was again the exclusive proprietor of Agrofert and maintained he was “implementing measures” to prevent a conflict of interest, but refused to disclose details.

Coalition Deal and International Consequences

The wealthy politician has concluded a governing pact with two minor right-leaning groups, the far-right, pro-Russian SPD, which has advocated a referendum on exiting the EU, and the Motorists for Themselves, which has mainly opposed the EU’s Green Deal.
