The NBA legend Testifies He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and novelty within the sport motivated his effort with 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Financial Stakes and a Will to Win

Jordan shared financial and corporate details of his racing venture, saying he put in $40m of his personal wealth into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “I was a new person, I had no fear. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”

The Core Dispute: Franchise System and Renewal Demands

At issue is the expiration of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other major leagues with independent franchises, such as the Charlotte Hornets or the NFL’s Panthers. The agreement was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan testified for an hour and exited the courthouse to a media frenzy, with onlookers and reporters clamoring for a view or a picture of the global icon.

Spearheading the Fight

23XI Racing is at the forefront of the push along with another racing team for Nascar to overhaul a business model Jordan said is breaking the law to maintain excessive control.

At issue for Jordan and a fellow team representative, who preceded Jordan, are details from last September. She recounted a frantic and emotional period where the racing circuit informed teams they had to sign a contract extension. This agreement consists of over a hundred pages detailing team compensation and a guaranteed spot in every race.

A Refusal to Sign

Jordan said that 23XI and Front Row Motorsports concluded their only feasible option was to decline to sign that 112-page package and litigate the matter. The other 13 organizations agreed to the terms.

Jordan and co-owner Denny Hamlin approached Nascar about possible changes or negotiations. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Victory

But in the end, the resistance against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Winning.

“Denny convinced me adding a third car boosted our odds of winning,” he said, noting that he purchased another franchise late in 2024 for $28m despite the uncertainty. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the contract signing demand was problematic.

According to her, Joe Gibbs first attempted to call and persuade Nascar against forcing signatures, but Nascar’s leader refused the appeal.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, I have 20. If I have 30, I have 30.”
